After the great New Jersey Samosa lawsuit, the stage is now set for the Mother of All Biryani Battles.

Big Indian legal fights in the U.S. are all about life-changing things like Samosas, Biryanis and, who knows, maybe in the future, even Gulab Jamuns and Jalebis. ;)

No kidding, guys.

And the venue for the Biryani battle is once again a court in New Jersey.

Facing each other in court are two Indian businesses – Paradise Biryani Pointe and Paradise Indian Grill.

Paradise Biryani Pointe vs Paradise Indian Grill – Mother of Biryani Battles

Paradise Biryani Pointe and its owner Narsing Raj Gowlikar have filed a lawsuit against Paradise Indian Grill and its associates alleging trademark infringement and unfair competition.

The claim to fame for both Paradise Biryani Pointe and Paradise Indian Grill restaurant chains is the famous Indian rice dish Biryani, although they offer other Indian food items as well.

Paradise Indian Grill declares on its web site that its signature dish is Dum Biryani. As for Paradise Biryani Pointe, the importance of Biryani is evident in its very name.

In its complaint, Paradise Biryani Pointe claims that it supplies pre-mixed spices to its franchisees to prepare the classic Biryani dishes (p.4 of complaint).

The recipes and pre-mixed spices are said to have been developed by complainant Narsing Raj Gowlikar and his wife Shailaja over a seven-year period.

Besides Paradise Indian Grill, other defendants named in the lawsuit include Guna Priya Babu Yalamuri, Surender Kesari, Rajbir Singh, Ravi Pallerla and Hari Rao.

Guna Priya Babu Yalamuri and his wife previously owned a stake in Paradise Biryani Pointe but are said to have relinquished their stake in June 2011 after an ‘incident’ on January 6, 2011 between Narsing Raj and Guna Priya.

We wonder what that incident was. ;)

Hey, it looks like some of the key folks involved in this battle royale Biryani are Telugus.

Paradise Biryani Pointe Seeks Preliminary Injunction

Paradise Biryani Pointe and Narsing Raj Gowlikar are seeking a preliminary injunction restraining Paradise Indian Grill and its associates from using the menu, words or logo of ‘Paradise Biryani Pointe’ and ‘Paradise Indian Cuisine,’ from using ‘Paradise Biryani’ or ‘Paradise’ in connection with the sale of Indian cuisine and to forfeit the profits realized through alleged infringements.

Paradise Biryani Pointe opened its first Biryani restaurant in North Brunswick, NJ in October 2007 and has since then expanded to other locations in New Jersey as well as four other states (Texas, Virginia, Georgia and Connecticut).

Paradise Indian Grill claims on its web site to be operating in six states but that’s inaccurate because some locations like Newark (DE) have yet to open.

On an unrelated note, we’d like to tell our readers that we recently had Paradise Biryani Pointe’s Egg Biryani (Edison, NJ location) and found it to be disgusting! :(

In or around January 2010, Ms.Bhardwaj’s husband in India needed an operation, and her children needed money to pay for it. Ms.Bhardwaj decided to ask defendant Prabhu Dayal for the money he said he was holding for her.

Ms.Bhardwaj asked for the money three times in one day, and he twice said they would talk later. On that day, Defendant Chandini Dayal was in India and Defendant Akansha Dayal was out of the house. That evening Ms.Bhardwaj made her third request for the money when Defendant Prabhu Dayal was seated in the living room. Defendant Prabhu Dayal said he would give her some work to do in order to get the money. He told her she would have to give him a massage for pain in his legs.

A lawsuit filed on June 20, 2011 in New York City charges Indian Consul General Prabhu Dayal with sexual harassment for demanding a massage from his maid-servant Santosh Bhardwaj.

In her complaint filed in the U.S. District Court for the Southern District of New York, the maid alleges that in January 2010 her employer Prabhu Dayal asked her for a massage when his wife was in India and daughter was out of the house.

The maid says that she immediately left the room and subsequently left her employer.

The complaint also alleges that Dayal did not pay Santosh Bhardwaj her promised wages, overtime wages and confiscated her passport.

In the suit, the maid alleges she was paid less than a dollar an hour in violation of state and federal employment laws. She is seeking unpaid wages, overtime wages and punitive damages.

Following a guilty plea for exposing his dick to a lady co-passenger on a Southwest Airlines’ flight from Philadelphia-Denver, Telugu bidda and SAP consultant Murali Krishna Nookella has been ordered by the U.S. District Court in Denver, Colorado to complete a program of mental health treatment and not travel on Southwest Airlines.

Here’s an excerpt from the court judgment in the Nookella case, dated August 19, 2010:

Smartsoft Violated H1B Rules
Indian software firm Smartsoft International, founded by Murugadass Krishnan and Shanthi Murugadass (Tamils??), has been royally screwed for H1B violations and ordered to pay $1 million in back wages and interest to 135 H1B workers employed by the company.

The U.S. Department of Labor’s Wage and Hour Division determined that Smartsoft violated the H-1B program’s rules.

A U.S. Labor Dept’s Wage and Hour Division investigator determined that some Smartsoft employees:

*  were not paid any wages at the beginning of their employment

* were paid on a part-time basis despite being hired under a full-time employment agreement

Remember the Telugu bidda Murali Krishna Nookella?

No? Nookella was the 35-year-old H1B desi dickhead and SAP consultant arrested on March 1 this year for allegedly exposing his dick to a lady co-passenger on a Southwest Airlines’ flight from Philadelphia-Denver.

Murali Nookella’s female co-passenger “C.S.A” had basically alleged that he was masturbating on the plane and that his erect dick had peeped out from below his blanket.

Now Murali Krishna Nookella has essentially admitted to exposing his dick on the commercial flight.

In a 11-page statement to the U.S. District Court in Denver dated May 5, 2010, Murali Nookella declared:

I wish to plead guilty to the following charge(s):

Count One of the Information charging a violation of 49 U.S.C. 46506(2), Obscene and Indecent Exposure on an Aircraft.

Statutory Penalties
The punishment for violation of 49 U.S.C. 46506(a) is up to 90-days of imprisonment or fine of up to $5,000 or both; up to one-year supervised release; $10 special assessment fee.

Americans Beat Coolies at Web Programming

Alas, these are hard times for Telugus (as residents of the South Indian state of Andhra Pradesh are known) in the U.S.

First it was Vikram Buddhi, who got into big trouble with the law.

Now another Telugu bidda Murali Krishna Nookella has landed in deep shit.

Murali Krishna Nookella, a 35-year-old H1B desi and SAP consultant, has been arrested for allegedly exposing his dick to a lady co-passenger on a Philadelphia-Denver flight on Monday.

Murali Krishna Nookella has been released on a $5,000 bond and prohibited from traveling by commercial airlines.

Murali Krishna Nookella’s request to be exempted from the travel restrictions was opposed by the government today.

If convicted on this misdemeanor offense, Murali Krishna Nookella faces a maximum of 90-days in jail and a $5,000 fine.

Murali Krishna Nookella is presumed innocent until he is convicted in a court of law.
